1. はじめに

『Pokémon Sleep』の公式ウェブサイト、 公式SNSその他関連サイトにてダウンロード可能な素材 （「DL素材」）は、株式会社ポケモン（「当社」）が管理しており、個人ユーザーの方のSNSにおけるプロフィール用アイコンまたはパソコンやスマートフォン上での壁紙画像としての使用のみを目的（「本件目的」）として無償提供されております。当該目的以外でご使用いただくことはご遠慮ください。

The downloadable materials made available on the official website, official social media, and other related sites of “Pokémon Sleep” (the “DL Materials”) are owned and managed by The Pokémon Company (the “Company”) and are provided free of charge exclusively for personal use by individual users as profile icons on social media or as wallpaper images on computers or smartphones (the “Purpose”). Any other purpose of use of the DL Materials is strictly prohibited.

2. 利用方法について
Usage Guidelines

DL素材は、手段や形態を問わず、改変・譲渡・翻案・貸与・二次使用ならびに商用利用することはできません。

The DL Materials may not in any form or by any means be modified, distorted, mutilated, adapted, reproduced, redistributed, transferred, lent, created derivative works from, or used for any commercial purposes.

3. 素材の使用停止等について
Cessation of Use, etc.

本件目的以外でご使用の場合や、犯罪に関連する行為や公序良俗に反する行為に使用する等、DL素材の使用が『ポケットモンスター』のイメージを損なう可能性がある場合、その他当社が必要と判断した場合、当社は、DL素材の使用停止を請求、または当社が必要と判断する措置を講じる可能性があります。あらかじめご了承ください。

If the DL Materials are used for any purpose other than the Purpose, or in connection with activities related to illegal conduct or acts contrary to public order and morality, or in any manner that could harm or damage the reputation or image of Pokémon, or in other cases deemed inappropriate by the Company, the Company reserves the right to require the user to immediately cease use of the DL Materials and/or take any other actions the Company deems necessary.

4. 知的財産権
Intellectual Property Rights

DL素材の一切の権利は、当社に帰属します。DL素材で使用している知的財産権等は、当社または正当な権利を有する第三者により保護されています。

All rights, title, and interest in and to the DL Materials, including all associated intellectual property rights (“Rights”), are property of the Company. The Rights are protected under applicable laws by the Company or third parties with legitimate rights.

5. ご利用に関する責任
Responsibility for Use

DL素材の使用に関連して生じるあらゆる損害について、当社は一切の責任を負いません。各ユーザーの責任においてご使用願います。DL素材の使用に関連し、当社または正当な権利を有する第三者に損害が発生した場合、当社は当該使用者に対し、当該損害の賠償を求める可能性があります。

The Company shall not be liable for any damages arising out of or in connection with the use of the DL Materials. Users hereby assume full responsibility for their use of the DL Materials. In the event that any use of the DL Materials results in damages to the Company or to any third parties with legitimate rights, the Company reserves the right to seek full compensation from the user responsible for such damages.

6. 準拠法等
Governing Law, etc.

1. ユーザーが DL素材を利用した時点で、本規約に異議なく同意したものとみなされます。
2. 本規約は日本法を準拠法とし、本規約に関する一切の紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

1. Utilization of the DL Materials by the user shall constitute the user’s unconditional agreement to these Terms of Use.
2. These Terms of Use will be interpreted in accordance with Japanese law. In disputes arising out of or in connection with these Terms, the Tokyo District Court will have exclusive jurisdiction in the first instance over such disputes.
